Shaykh Al-Albaanee Faulting Some Principles Usually Cited in Tabdee

Shaykh Al-Albaanee - rahimahullaah - was asked about the ruling on the principle that says 'whoever does not declare a heretic as a heretic is himself a heretic and that whoever is not upon our view is against us.'

He - rahimahullaah - answered: 'Who brought these principles? Who propounded them?'

Then he - rahimahullaah - mentioned the story of one of the scholars in Albania who would declare whoever did not honour his shoes as kaafir because to him was disrespectful to a scholar, and whoever does not honour a scholar has not honoured knowledge and consequently such a person has not honoured the Messenger of Allaah (ï·º) who brought the knowledge then Jibreel who brought it to the Messenger of Allaah (ï·º) then Allaah Who sent the knowledge! 

Al-Imaam Al-Albaanee - rahimahullaah - said further: 

'It is never a condition that whoever declares a person a kaafir and establishes the proofs against him that everyone should support him on that, becuase the person he declares a kaafir could have misinterpreted (the text) such that another scholar would opine that it is not permissible to declare him a kaafir, or a sinner or a mubtadi (as the case may be).'

'This is however the situation of those afflicted with this kind of thought in this era, and from the hastiness of some youths who claim knowledge.'

'What we are saying is that this chain (of continuous tabdee of a person who does not support a tabdee of another person) and Ilzaam (compulsion) is never imperative.'

'This is a wide field where a scholar might see a matter as obligatory while another scholar will view it another way.' 

'Scholars of old and recent would not have differed on such if not becuase it is a matter of ijtihaad (where a scholar can make deductions), thus it is not compulsory that other scholars should follow the view of a scholar, it is only a muqallid (a common Muslim) who has no knowledge that must follow (any scholar), as for a person of knowledge, who is of a different view, he is never mandated to follow that scholar who declares a person a kaafir or a sinner or a mubtadi.'

وسئل الشيخ الألباني رحمه الله عن صحة هذه القواعد من لم يكفر الكافر فهو كافر، ومن لم يبدع المبتدع فهو مبتدع، ومن ليس معنا فهو ضدنا.
فأجاب بقوله: «من هو صاحب هذه القواعد ومن قعدها؟ ـ على سبيل الإنكار، ثم ذكر قصة أحد علماء ألبانيا الذي كفر من لم يهيئ له نعله للخروج من الدار حيث قال ـ واللفظ للألباني ـ : «هذا كفر لأنه لم يحترم العالم ومن لم يحترم العالم لا يحترم العلم، والذي لا يحترم العلم لا يحترم من جاء بالعلم، والذي جاء بالعلم هو محمد صلى الله عليه وسلم، وهكذا سلسلها إلى جبريل إلى رب العالمين، فإذاً هو كافر».
ثم قال الشيخ الألباني ـ رحمه الله تعالى ـ : «ليس شرطاً أبدا أن من كفَّر شخصاً وأقام عليه الحجة أن يكون كل الناس معه في التكفير، لأنه قد يكون متأولاً، ويرى العالم الآخر أنه لا يجوز تكفيره، وكذلك التفسيق والتبديع، فهذه الحقيقة من فتن العصر الحاضر، ومن تسرع بعض الشباب في ادعاء العلم.
المقصود أن هذا التسلسل وهذا الإلزام غير لازم أبداً، هذا باب واسع قد يرى عالم الأمر واجباً ويراه الآخر ليس كذلك، وما اختلف العلماء من قبل ومن بعد إلا لأنه من باب الاجتهاد، لا يُلْزِم الآخرين أن يأخذوا برأيه، الذي يُلزم بأخذ رأي الآخر إنما هو المقلد الذي لا علم عنده وهو الذي يجب عليه أن يقلد، أما من كان عالمًا فالذي كفَّر أو فسَّق أو بدّع ولا يرى مثل 
رأيه فلا يلزمه أبدا أن يتابع ذلك العالم
