Re- Abu Aasim Al-Athari's 'Suicide Bombings' On the Scales Of Islamic Law [Part Two]

All praise to Allaah I testify there is none worthy of worship except Him, and I bear the testimony that Muhammad is His slave and Messenger.

We have downloaded and read the critique uploaded by a fellow on one of the social media criticizing An-Naseehah Magazine for its Jan/Feb 2010 edition that was captioned 'The Recompense for a Murderer' wherein it discussed some rulings of the legitimate Jihaad – what is approved thereof and what is not. The magazine fronted the position of the custodians of knowledge of the time and warned the Muslim youths from overzealousness and going beyond the bounds such as falling in the hands of some evil callers who mislead the youths in believing that Jihâd must be fought today no matter what.

The magazine specifically made a case for many innocent Muslims whose lives had been lost in many of the so-called 'jihaad' battles. An evidence of which abounds in Nigeria, as an instance. That was treated under the topic, 'The Blood of a Muslim is Sacred.' It is from this angle the writer of the critique which we are rebutting here polemically debunked by mixing up the texts of the Shareeah, confusing the statements of scholars of old and past to justify some of the heinous crimes they carry out in the name of Jihad. We ask Allaah for protection.

Thus the writer did not mince words in declaring that he – and his cronies – are in support (if not members) of Al-Qaeda Group (we are already in a Fitnah!). He did praise the ignoble act of the misguided youth, Umar Abdul-Mutallib, who attempted to blow up a passengers' plane on a Christmas Day in 2009. Thus, he encourages more youths to follow his step. What a misplaced priority!

In order to debunk the availability of legitimate rulers as a requirement for Jihad, he, at one point, argued that Muslims should accept the likes of Osama bn Laden, Aymaan Az-Zawahiri, Mullah Umar (the Taliban Soofi cleric) etc. as the legitimate rulers of the Muslims world over therefore whatever verdicts they passed regarding Jihaad must be accepted.

He said all the Muslims must unite with them to form a caliphacy! He vouched for Islamic Emirate of Afghanistan to be united with Iraq, Somalia, Chenchya, etc.

He in fact, created a scene of chaos in the Muslim Ummah in the sense that the whole of Ummah is depicted as lacking the right people of knowledge who can guide the Ummah to what is righteous. The scholars he praises are people like Yuusuf al-Qaradawi, Fat'hi Yakan, Abu Yahya Al-Libbi, etc. If he mentioned the likes of Shaykh Uthaymeen, Shyakh bn Bazz, etc. he mentioned them to cite their words contradictorily; systematically and polemically refuting them in the process. He very much buttressed a fatwa of Shaykh al-Albaanee on the permissibility of what looks like a suicide bombing yet not sparing the Shaykh from his virile attacks.

What the scholars of old did say about Al-Iqtihaam and Al-Inghimaas – plunging into the enemy ranks in the battle to kill as many as possible of them in a battle, he used as a justification for suicide bombings which have claimed many Muslim lives.

Under the concept of At-Tattarus – attacking Muslims that are used as shields by the enemy, he justified the killing of Muslims in their suicide or otherwise bomb attacks. They are regarded as collateral damage.

As for ordinary non-Muslims, they are all targets. Since there is no known treaty between them and the Muslims, they can be killed. Some Muslim states who have the likelihood of the treaty only do so on their own, other Muslims are not binded by the terms of such treaties. So those non-Muslims killed in the 9/11 attacks – which he gallantly praised, were worthy of being killed. He created a picture of every Muslim getting a weapon and killing the nearest non-Muslim. The requirement of calling to the path of Allaah with a beautiful exhortation, he threw into the dustbins. Muslims must cease to be apologetic. He says every Muslim must see that there is a war between Islam and the West!

That is just the summary of what he wrote in the evil book.

As I was attempting to bring the real refutation of the book, the fellow that brought the electronic copy of the book to the Internet cried foul. He accused me of unfairness in my brief assessment of the book thus I saw he was not intrested in what I was going to write and going by the fact that I was pretty busy thus I shelved the idea but referred the readers to an article prepared for www.simplysalafiyyah.com entitled Jihaad in the Salafi Perspective.
