Then, when does the timing begins? From wearing? Or From the first defecation? Or from the first wiping?
The Messenger of Allaah (sallaLlaahu 'alayhi wa sallam) said:
The time limit for wiping over the socks for a traveller is three days (and three nights) and for a resident it is one day and one night.The narration indicates, the time is the time of wiping, not the time of defecation. Then, there is nothing like defecation mentioned in any narration.It is not right to deviate from what is glare from the statement of the messenger (sallaLlaahu 'alayhi wa sallam) to someone's else statement, except with the narration from the messenger (himself) or consensus that indicates its specification.
From what makes this opinion clearer is the statement of 'Umar regarding wiping over leather socks: both should be wiped over, to its exact time, starting from its day and night(Ibn Mundhir, Abdur Razzaaq and Bayhaqee collected it).
There is no doubt that,'Umar knew better the meaning of the saying of the messenger of Allaah than anyone else, he is from one of those who reported the narration of wiping over the leather socks from the prophet (sallaLlaahu 'alayhi wa sallam). His position in the religion is his position (that is, lofty). The prophet(sallaLlaahu 'alayhi wa sallam) said: Follow the two after me: Aboo Bakr and 'Umar(Ahmad, Tirmidhee and Ibn Maajah with a good chain).
An-Nawaawee said(Al-Majmoo' vol.1 p.487): This is the selected and the preponderant evidence.
Clarifications
Ash-Shaykh Saalih Al-'Uthaymeen said(Majmoo' Al-Fataawah vol.7 pp.
161-162): There is no consideration to the number of the prayers, rather the time. The messenger of Allaah(sallaLlaahu 'alayhi wa sallam) timed it with day and night for the resident and three days for the traveller.A day and night is twenty four hours while three days and nights is seventy-two hours.
But, when does this extension starts? The extension starts from the first wipe, neither from wearing the leather socks nor from the defecation after wearing (the leather socks). Because, the Shari'ah came with the wording of "wiping", and wiping is not possible except the action has been implemented: The resident will wipe it for a day, while the traveller will wipe it for three days.Wiping must be implemented and it is not possible except at the beginning of wiping at once.When twenty-four hours is completed from the beginning of wiping, the time of wiping has ended for the resident. And, when seventy-three hours is completed from the beginning of wiping, the time of wiping is ended for the traveler.
Stipulation of Wiping Over Leather Socks on Purification.
The scholars agreed upon the stipulation of wiping over leather socks on purification, for whosoever wishes to wipe over them as it is contained in Al-Fat'h vol. 1 p.309,Al-Mughee vol.1 p.284 and Al-Majmoo' vol.1 p.518.
Shaykh Islaam Ibn Taymiyyah(Al-Ikhtiyaraat p.14) said: Whosoever washes one of his legs, then he wears his leather socks prior washing the other, he has right to wipe over it, without the stipulation of removal.Wearing it before the completion of the purification is like wearing it after purification. It is one of the reports from Ahmad and the school of thought of Imaam Abee Haneefah.
Does the Removal of the Leather Socks Vitiate Ablution?
Those who have the opinion that, it doesn't need to redo the ablution and washing of the legs (that is: it doesn't vitiate the ablution) cite the evidence that, leather socks is completely purified with the purification substantiated with the authentic sunnah. It is not right to claim its vitiation when it was removed, except with authentic evidence from either the sunnah or Ijmaa' (consensus). There is no evidence with those who made it an oblgation to redo the ablution or washes the two legs.
The evidence for this is textual and rational.
i) It was authentically reported(At-Tahaawee Sharh Ma'aanee Al-Athar vol.1 p.97 Abdur-Razzaaq 783,Ibn Abee Shaybah vol.1 p.190 and Al-Bayhaqee vol.1 p.288) from Alee bn Abee Taalib that, he defecated, then performed ablution, then wipe over his shoes, the he reomoved it and prayed.
ii) If a person wipe his head and later shaves it, it is not an obligation upon him to wipe let alone ablution.
This is the opinion of Ibn Taymiyyah in Al-Ikhtiyaar and Al-Albaanee in at-Tammaam.
Note: What if an individual removed tge wiped socks and he then wears it. Is it allow for him to wear it again and wipe over it?
The correct answer-Allaah willing- is it not allowed.
Wearing Socks over Socks
There is no problem in this, if the two socks (worn over one another) are worn upon purification. As in the basic ruling.
But, if the second is worn when dedicated, it is not allowed to wipe over it(some of the scholars, like An-Nawaawee deemed it allow, but there is no evidence on it).Even if he removes the second socks-that he wore upon purification-it is allowed for him to continue wipe over the first socks(Majmoo' al-Fataawah of Al-'Uthaymeen vol.7 p.193-purifucation).
I(Al-Halabee)say: Its ruling is the same to who wears shoes over socks, on the condition that he wore it upon purification.
Does the Termination of the Stipulated Time Vitiates Ablution?
Whosoevr his stipulated time for wiping terminates and he does not defecate: there is no evidence that hus purification has terminated, even neither from a part of his body nor all of his body. He is clean and can pray until he defecates. And by this time, he should remove his leather socks from his legs and perform ablution, then he should begin again wiping time.
Does it need to Preceed Wiping with the Intention of for the Deadline of Wiping?
Ash-Shaykh Saalih Al-'Uthaymeen said (Majmoo' al-Fataawah vol.7 p.165): Here, the intention is not an obligation.
