Fiqh Jum'ah (I)

Compilation and Translation: Aboo Aamir Ishaaq b. AbdirRaheem

Bismillaahir Rahmaanir Raheem

On the authority of Samurah b. Jundub, may Allaah be pleased with him, the Prophet -salallaahu alayhi wa sallam - said:

من ترك الجمعة متعمدا، فليتصدق بدينار، فإن لم يجد فبنصف دينار.

'Whoever knowingly misses the Jum' ah should give charity with a deenaar, if he cannot get it then half a deenaar.'

Reported by Aboo Daawud in his Sunan (1053), An-Nasaa'ee in al-Mujtaba (3/89), Ahmad in al-Musnad (5/8 and 14), Ibn Hibbaan (582) and al-Haakim in al-Mustadrak (1/280) in the route of Qudaamah b. Wabrah from Samurah b. Jundub. There is Qudaamah b. Wabrah in the chain. Al-Imaam Ahmad said: 'He is unknown.' Ibn Maeen said: 'He is trustworthy.' Al-Bukhaaree said: 'That he heard Samurah is not authentic.

Said Aboo Ubaydah, Ash-Shaykh Mash'hoor Hasan al-Salmaan - may Allaah preserve him: 'He (Qudaamah b. Wabrah) was not the only reporter from Samurah, Al-Hasan (Al-Basree) also did as was recorded by ibn Maajah in as-Sunan (1128). Meanwhile Ibn Hibbaan and al-Haakim graded the hadeeth as authentic and adh-Dhahabee agreed with them.

Issue Arising from the Hadeeth

Some scholars say the command in the hadeeth is a recommendation because whoever ordinarily misses the Jum'ah will pray Dhuhur in its place. As-Shaykh Hasan - may Allaah preserve him - however said the command remains a command even when Jum'ah is known to have what could be observed in its stead. It can be that the expiation with money goes with re-observing it with Dhuhur to serve as a punishment for he who abandons it for no tenable reason.
