Ninth caller: I once heard a lecture that when a person dies and has been buried, whatever property they left behind must be shared amongst their heirs to relieve them in their grave. My mom passed away about five years ago but was married to another man after she separated with my dad. However, this man claims my mother owned nothing before she got married to him hence his children are the only ones entitled to the properties. What steps could I take to claim my inheritance?

Shaykh: Firstly, the lecture you heard conflicts the teachings of the shariah. When anyone dies, the responsibility of sharing the properties rests of the survivors and they must act promptly. From the deceased properties are those things that can't be preserved for long before they go off. For example, If the deceased had some pieces of cake which he just bought, how long can a cake last? Or he just made a stew, how long can this be preserved? Hence, you must share the inheritance promptly. We are the ones in need of these properties not him contrary to the saying that the dead won&t be relieved in the grave until the inheritance is shared. He has no business with your actions! He has gone. You are the ones left to inherit the properties and you have demonstrated that you have absolutely no clue about what to do with money evidenced by your delay in sharing your inheritance. The deceased has nothing to do with this, your mum won't experience any torture as a consequence of not sharing her properties. You should summon courage and be conscious of your religion, go to that man who confiscated your mother's properties with the claim that he married her when she had nothing and all she owned was after she got married to him…(laughs). What kind of fiqh is this?

This is incorrect. How could he separate you from your mother! Why do people even say that which they have no knowledge about? what kind of judgment is this? Even if you married her with some properties and nothing of those properties increased after your marriage for twenty years, your own children would still inherit from those properties. So avoid further ado and allow them share the inheritance, you would also benefit from it in accordance to the injunctions of Allah. The deceased has no business with this, the onus is on all of you. 

Tenth caller: If we met the Imam on tashaahud. Must we still say iqaamah after he makes tasleem?

Shaykh: You shouldn't say iqaamah after they do tasleem rather you must carry on with your salah. However, you could leave your salah to join another congregation upon hearing their iqaamah because you didn't catch the salah but the jama'ah while it&s the solat that's important to catch. Therefore, you should join the new congregation so you can pray your salah in congregation. 

Eleventh caller: I would like to ask our shaykh (may Allah preserve him) regarding the ruling of cutting the newborn&s hair and giving its weighed equivalence in charity. Is there any deadline for observing this injunction as there&s a person who forgot to perform that and the child has grown to be two years now?

Shaykh: There's no deadline, it depends on how much and heavy the hair is on the scales. However, if it&s weighed, it would probably not exceed two to three thousand naira. Na'am.

Twelfth caller: I promised to give someone some items but they refused to show up for it then I sold it after a year. Have I done anything wrong?

Shaykh:You haven't done anything wrong because you already informed them about it however, they took too much time to come for it. Allaah's injunction says, 'There's no cause for blame upon the good doers'. If he eventually shows up requesting the items, tell him you have sold it. There's no sin in this.

Thirteenth caller: If a woman had a miscarriage, would she keep praying with the bleed?   

Shaykh: All praise is due to Allah. As long the pregnancy was lost before the fetus was fully formed i.e. before four months, then it's not postpartum bleeding rather it's 'Damu-Fasaad' (Filthy blood). This doesn't prevent one from observing salah, she should make purification before each salah and carry on with her acts of worship. This indicates that never should we joke with our religion and become heedless about it especially concerning patients in the hospital. Some have been admitted for weeks and have been eating and even complaining about the meat they were served but refused to worship Allah for those weeks. If death comes upon you, you would die a disbeliever! The relatives who care for the patients and provide food for them also refuse to remind them to worship Allah, this indicates that they are also pleased to see them die as disbelievers. Let's be mindful.
