Bismillaah-ir-Rahmaan-ir-Raheem
عن سَهْل٠بْن٠أَبÙÙŠ Øَثْمَةَ قَالَ انْطَلَقَ عَبْد٠الله٠بْن٠سَهْلÙ
بْن٠مَسْعÙود٠بْن٠زَيْد٠إÙÙ„ÙŽÙ‰ خَيْبَرَ وَهْيَ يَوْمَئÙذ٠صÙلْØÙŒ ÙَتَÙَرَّقَا Ùَأَتَى Ù…ÙØَيّÙصَة٠إÙÙ„ÙŽÙ‰ عَبْد٠الله٠بْن٠سَهْل٠وَهْوَ يَتَشَØÙ‘ÙŽØ·Ù ÙÙÙŠ دَم٠قَتÙيلاً ÙَدَÙÙŽÙ†ÙŽÙ‡Ù Ø«Ùمَّ قَدÙÙ…ÙŽ الْمَدÙينَةَ Ùَانْطَلَقَ عَبْد٠الرَّØْمَن٠بْن٠سَهْل٠وَمÙØَيّÙصَة٠وَØÙوَيّÙصَة٠ابْنَا مَسْعÙود٠إÙÙ„ÙŽÙ‰ النَّبÙيّ٠صلى الله عليه وسلم Ùَذَهَبَ عَبْد٠الرَّØْمَن٠يَتَكَلَّم٠Ùَقَالَ كَبّÙرْ كَبّÙرْ وَهْوَ Ø£ÙŽØْدَثÙ
الْقَوْم٠Ùَسَكَتَ Ùَتَكَلَّمَا
It was narrated from Sahl bn Abee Hathma that he said: ‘Abdullaah bn Sahl and Muhayyisah bn Mas’ood bn Zayd went to Khaibar, which that day was under a treaty, they separated and Muhayissah later found Abdullaah bn Sahl in a pool of blood murdered. Muhayyisah buried then the dead. When he arrived in Madeenah, AndurRahmaan bn Sahl (the son of the murdered), Muhayyisah and Huwayyisah (said to be sons of the uncle to the murdered), who were two sons of Mas’ood, went to the Prophet (salallaahu alahyi wa sallaam), AbdurRahman attempted to speak for them but the Messenger of Allaah (salallaahu alayhi wa sallaam) said: ‘Kabbir! Kabbir! [Let the elders speak! Let the elders speak!]’, he was the youngest among them. So he kept quiet and the elders spoke…
Al-Bukhaaree and Muslim.
Al-Imaam bn Baz –rahimahullaah – said: ‘[This hadeeth] indicates that people of honour, knowledge and age should be preferred ahead others (in matters of public safety and others), and that this point should be given some importance (in the Muslim community), because when we do so, we have placed them in the position Allaah has placed them…and that whenever there is a dispute between three persons or more, the eldest among them should speak (for a party) unless they agree that someone younger in age should speak because he understands the issue at hand than others, then there will be no problem if they do so otherwise the elders take preference as the Messenger of Allaah – sallallaahu alahyi wa sallaam – said: ‘Kabbir!
